PMA Terms of Service
Free Beta Edition — Version 1.1 Effective date: September 26, 2026
Operator: Project Mad Adder Contact: admin@projectmadadder.com
1. About PMA and These Terms
Project Mad Adder (“PMA”, “we”, “us”, or “our”) provides an animal husbandry and collection-management service.
These Terms govern access to and use of the PMA application, websites, and related services (collectively, the “Service”).
By accepting these Terms, you agree to comply with them.
If you access or use PMA on behalf of a business, organization, or other entity, you confirm that you have authority to accept these Terms on its behalf.
The Service is currently offered as a free beta. Additional terms may apply to future paid plans, marketplace services, integrations, or other optional services. Those terms will be presented separately before they apply.
Our Privacy Notice explains how PMA collects, uses, discloses, retains, and protects personal information. Acceptance of these Terms does not constitute consent to a materially different use of personal information where separate consent is required by applicable law.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of agreeing to these Terms in your jurisdiction to create or maintain a PMA account.
PMA is intended for adult users involved in animal care, breeding, collection management, related businesses, or similar activities.
PMA does not knowingly permit people under 18 to maintain accounts. If PMA becomes aware that an account is being maintained by a person under 18, PMA may suspend or close that account and handle associated information in accordance with the Privacy Notice and applicable law.
You agree to:
- provide accurate account information;
- maintain the security of your login credentials;
- not permit unauthorized access to your account; and
- notify PMA promptly if you reasonably suspect unauthorized access or compromise.
You are responsible for activity conducted through your account except to the extent that the activity results from PMA's own failure to meet obligations that cannot lawfully be excluded.
PMA may require reasonable verification of identity or authority before processing certain account, workspace, privacy, export, or administrative requests.
3. Free Beta Access
PMA beta access is provided free of charge.
Access may be subject to application approval, capacity limits, technical requirements, geographic restrictions, acceptable-use requirements, or other reasonable eligibility criteria.
Submitting an application or creating an account does not guarantee continued access to the beta.
Beta features may:
- be incomplete;
- contain defects or errors;
- change during development;
- be temporarily unavailable;
- produce inaccurate results; or
- be added, modified, restricted, or discontinued.
PMA will use reasonable efforts to communicate material changes where appropriate.
Beta access will never automatically convert into a paid subscription.
PMA will not charge you merely because the beta ends.
Any future paid subscription will require a separate affirmative purchase decision after applicable pricing, billing, renewal, and payment terms have been disclosed.
4. Animal Care and Use of Information
PMA provides software tools for recording, organizing, analyzing, and managing animal husbandry and related information.
PMA is not:
- a veterinary practice;
- an emergency-monitoring service;
- a substitute for qualified veterinary advice;
- a guarantee of animal health or welfare outcomes; or
- a guarantee of breeding, genetics, business, or financial outcomes.
Species information, husbandry information, care recommendations, genetic probabilities, forecasts, alerts, artificial-intelligence outputs, automated analysis, and other information provided through PMA may be incomplete, inaccurate, delayed, or inappropriate for a particular animal or circumstance.
You remain responsible for:
- directly observing animals under your care;
- maintaining appropriate husbandry;
- verifying information important to animal care or business decisions;
- maintaining appropriate equipment and environmental controls;
- complying with applicable animal-care and wildlife laws; and
- obtaining qualified veterinary or other professional assistance where appropriate.
You should not rely exclusively on PMA for urgent, safety-critical, or time-sensitive animal-care decisions.
Nothing in these Terms excludes or limits responsibilities or rights that cannot lawfully be excluded or limited.
5. Customer Data and Ownership
You retain your rights in animal, husbandry, breeding, business, media, customer, inventory, and other records that you lawfully submit to PMA (“Customer Data”).
You grant PMA a limited, non-exclusive permission to host, store, process, transmit, reproduce, display, back up, and otherwise handle Customer Data only as reasonably necessary to:
- provide the Service;
- operate requested features;
- maintain and secure PMA;
- provide support;
- investigate technical or security problems;
- comply with applicable legal obligations; and
- perform other processing described in the Privacy Notice.
This permission does not transfer ownership of Customer Data to PMA.
PMA does not sell private Customer Data.
PMA does not use private Customer Data to train PMA or third-party general-purpose artificial intelligence models.
Optional AI-enabled features may require information submitted to or used by that feature to be processed in order to generate the requested result. Additional information concerning such processing will be provided where appropriate, and PMA will assess relevant provider and data-handling arrangements before private Customer Data is processed through optional AI services.
You are responsible for ensuring that you have the necessary rights, authority, notices, and consents to submit information to PMA, including personal information relating to employees, customers, suppliers, contacts, or other people.
You must not upload content that you do not have the legal right to possess, use, or provide to PMA.
6. Privacy, Service Providers, and Security
PMA collects and processes information necessary to administer accounts, operate the Service, provide requested features, store Customer Data, maintain security, communicate with users, provide support, and meet applicable legal obligations.
The PMA Privacy Notice provides additional information concerning:
- categories of personal information processed;
- purposes of processing;
- service providers;
- international processing;
- cookies and browser storage;
- retention;
- account deletion;
- privacy rights; and
- privacy and security contacts.
PMA relies on third-party infrastructure and service providers to operate the Service. Information may be processed in jurisdictions outside Canada as described in the Privacy Notice.
PMA uses administrative, technical, and organizational safeguards intended to protect personal information and Customer Data against unauthorized access, use, disclosure, alteration, loss, or destruction.
No internet-based service can guarantee absolute security.
PMA does not guarantee that Customer Data can always be recovered following deletion, corruption, hardware failure, software failure, third-party failure, security incidents, or other loss.
You should maintain appropriate independent records or backups of information that is critical to your animals, business, legal obligations, or operations.
PMA will investigate suspected privacy or security incidents and provide notifications where required by applicable law.
7. Workspaces and Authorized Users
PMA may permit multiple people to collaborate within organizations or workspaces.
Access to workspace information is governed by roles, permissions, ownership, membership, and other access controls provided through the Service.
Workspace owners and administrators are responsible for:
- managing authorized membership;
- assigning appropriate permissions;
- removing access when it is no longer required; and
- ensuring that users are appropriately authorized to access workspace information.
PMA will not intentionally transfer workspace ownership or disclose private workspace records to unauthorized parties.
Account deletion, workspace deletion, ownership transfers, exports, or other administrative actions may require verification of identity, authority, or workspace ownership.
An individual user's account rights do not necessarily give that user authority to delete, export, transfer, or control records owned by another organization or workspace.
8. Acceptable Use
You agree to use PMA lawfully and responsibly.
You must not:
- attempt to obtain unauthorized access to PMA or another user's account or information;
- interfere with or disrupt the Service;
- distribute malicious software or code;
- compromise another person's privacy;
- impersonate another person or organization;
- circumvent security, authentication, permissions, rate limits, or access controls;
- use PMA to facilitate unlawful wildlife trafficking;
- use PMA to facilitate animal cruelty;
- use PMA to commit fraud;
- knowingly falsify records where doing so would be unlawful;
- use PMA for other unlawful conduct; or
- intentionally use automation in a manner that materially disrupts the Service.
You are responsible for complying with laws applicable to your own animal ownership, care, breeding, sale, transport, import, export, record keeping, and other activities.
Supported APIs, integrations, exports, automation, NFC, QR, AI, and other PMA features may be used within their documented or reasonably communicated limits.
PMA may impose reasonable technical restrictions where necessary to protect the Service, other users, or third parties.
9. Availability, Features, and Changes
PMA aims to provide a useful and reliable Service, but beta availability is not guaranteed.
Access may be interrupted or affected by:
- maintenance;
- defects;
- software errors;
- database failures;
- hosting or infrastructure problems;
- telecommunications failures;
- third-party outages;
- security incidents;
- changes to third-party services; or
- circumstances outside PMA's reasonable control.
PMA may add, modify, test, restrict, replace, or discontinue features as the Service develops.
Where practicable, PMA will provide reasonable notice of material changes that significantly affect users or their records.
A change in subscription plan, beta status, or future product tier does not by itself authorize PMA to delete Customer Data.
The handling of retained Customer Data remains subject to these Terms, the Privacy Notice, applicable workspace rights, and applicable law.
10. Suspension, Account Closure, Deletion, and Data Continuity
PMA may restrict or suspend access where reasonably necessary to:
- address a security risk;
- prevent unauthorized access;
- investigate suspected unlawful conduct;
- respond to a material violation of these Terms;
- protect PMA or other users;
- comply with applicable law; or
- respond to activity that threatens the integrity or availability of the Service.
Where reasonably practicable, PMA will provide notice and an opportunity to address the issue before permanent closure, unless immediate action is reasonably necessary for security, legal, safety, or abuse-prevention purposes.
You may request account closure using available account controls or by contacting PMA.
Account closure and workspace deletion are separate processes.
Closing or deleting an individual account does not automatically authorize deletion of records belonging to another workspace, organization, owner, or other authorized users.
PMA will handle access, export, correction, deletion, and retention requests in accordance with its Privacy Notice and applicable law.
Personal information and Customer Data that are no longer reasonably required will be deleted, erased, anonymized, or otherwise disposed of in accordance with applicable retention procedures and legal obligations.
Certain information may continue to be retained where reasonably necessary for security, legal compliance, dispute resolution, fraud or abuse prevention, enforcement of these Terms, maintenance of required records, or establishment, exercise, or defence of legal claims.
Information removed from active systems may remain temporarily in backups, security records, logs, or residual systems until it expires, is overwritten, or is deleted through normal retention processes.
11. Intellectual Property
PMA and its licensors retain ownership of the Service and its software, source code, designs, interfaces, trademarks, branding, documentation, databases, proprietary systems, and other intellectual property, excluding Customer Data and other material owned by users or third parties.
Subject to these Terms, PMA grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for authorized purposes during the period in which you are permitted to use PMA.
Except where permitted by applicable law or expressly authorized by PMA, you may not:
- resell or sublicense the Service;
- copy or commercially exploit PMA software or proprietary materials;
- reverse engineer or attempt to extract source code;
- bypass technical restrictions; or
- use PMA intellectual property in a manner that falsely suggests sponsorship, affiliation, or endorsement.
Nothing in these Terms transfers ownership of PMA intellectual property to you.
12. Disclaimers and Liability
PMA is beta software.
To the extent permitted by applicable law, PMA does not guarantee that the Service will:
- operate without interruption;
- be error-free;
- always preserve or recover data;
- produce accurate automated results;
- remain compatible with every device or third-party system; or
- be suitable for every particular purpose.
You should not rely exclusively on beta software for critical animal-care, emergency, regulatory, legal, financial, or business decisions.
To the extent permitted by applicable law, PMA is not responsible for losses caused by circumstances outside its reasonable control.
To the extent permitted by applicable law, PMA excludes liability for indirect, incidental, special, exemplary, or consequential losses arising out of or relating to use of, inability to use, or reliance on the Service.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any liability, statutory protection, or consumer right that cannot lawfully be excluded or limited.
Nothing in these Terms prevents you from exercising rights or remedies that applicable law does not permit these Terms to waive.
13. Communications
PMA may send communications reasonably necessary to operate the Service, including:
- authentication and account messages;
- password-reset messages;
- security notices;
- invitations;
- requested support communications;
- privacy or data-request communications;
- requested exports;
- important service announcements; and
- material legal or policy notices.
These operational communications are separate from optional marketing communications.
Marketing communications are not a condition of accepting these Terms.
Where PMA sends marketing communications, users will be provided with an appropriate method of withdrawing consent or unsubscribing where required by applicable law.
14. Changes to These Terms
PMA may update these Terms to reflect changes to the Service, applicable law, security requirements, or business operations.
Updated Terms will identify their version and effective date.
Material changes will be communicated through the Service or another appropriate channel.
Where a new version requires acceptance, PMA may require you to review and accept it before continuing to use some or all Service functionality.
PMA will preserve records of Terms acceptance where reasonably necessary for legal, administrative, or security purposes.
Acceptance of these Terms will not be treated as consent to a materially different collection, use, or disclosure of personal information where applicable privacy law requires separate or fresh consent.
If you do not agree to a required new version, you may discontinue use of PMA and request available account closure or data-export assistance, subject to applicable workspace rights, security requirements, retention requirements, and applicable law.
15. Governing Law and Disputes
These Terms are governed by the laws of New Brunswick and the applicable federal laws of Canada, without limiting mandatory consumer, privacy, or other legal protections that apply in a user's jurisdiction.
Before commencing formal proceedings, you and PMA are encouraged to contact one another and make a reasonable attempt to resolve the dispute in good faith.
Nothing in these Terms prevents either party from exercising rights before a court, regulator, privacy authority, consumer-protection authority, or other competent body where applicable law provides that right.
